1.Acceptance of these terms
These Terms of Use ("Terms") are an agreement between you and HomeTrust Ltd ("HomeTrust"), a company incorporated in Rwanda. They apply when you visit our website, create an account, use HomeTrust Check, HomeTrust Protect or the HomeTrust API, or complete a verification, guarantor or reference request.
By using the services you agree to these Terms and to our Privacy Policy. If you use HomeTrust on behalf of a business, you confirm you are authorised to bind that business. Field agents are additionally bound by the Agent Terms and Conditions.
2.Definitions
- Employer — a household or business with a HomeTrust account that requests verifications.
- Applicant — a person invited by an employer to complete a verification.
- Report — the verification report, including trust score and check results, produced for an employer.
- Incident — a report submitted through HomeTrust Protect about the conduct of a worker.
- Wallet — the prepaid RWF balance in an employer account used to pay for services.
3.Eligibility and accounts
- You must be at least 18 years old and able to enter into a binding contract under Rwandan law.
- You must give accurate account information and keep it up to date.
- You are responsible for keeping your password and API keys confidential and for all activity under your account. Tell us immediately at support@hometrust.rw if you suspect unauthorised use.
- Business accounts may add team members; the account owner is responsible for their use of the services.
4.The services
HomeTrust provides:
- HomeTrust Check — identity, face match, liveness, guarantor, previous employer, address, criminal record and health screening checks, delivered as a report.
- HomeTrust Protect — reporting of incidents and searching of verified incidents.
- HomeTrust API and Verify Links — programmatic and no-code access to the services.
We may add, change or withdraw features. We will give reasonable notice of changes that materially reduce the services you have paid for.
5.Employer obligations
When you request a verification you agree that you will:
- use HomeTrust only to assess a person for genuine employment or engagement, and not for any other purpose (such as tenancy decisions, debt collection or personal curiosity);
- tell the applicant that you are using HomeTrust and request only checks that are proportionate to the role;
- not pressure an applicant to consent, and respect their decision if they refuse;
- not discriminate on grounds prohibited by Rwandan law, including ethnicity, religion, sex, disability or health status;
- keep reports confidential, use them only for your hiring decision and not share them with third parties except as required by law;
- comply with Law N° 058/2021 on the Protection of Personal Data and Privacy as an independent controller of the reports you receive; and
- give the applicant a fair opportunity to explain an adverse result before making a final decision.
6.Applicants, guarantors and referees
- You must provide true and complete information and only submit your own identity documents and selfie.
- Guarantors and referees must answer honestly and only from their own knowledge.
- Submitting false documents, impersonating someone or giving false statements may be reported to the Rwanda Investigation Bureau and may be a criminal offence.
- Verification links are personal to the person invited and expire after 7 days.
7.Incident reporting rules
If you submit an incident through HomeTrust Protect you confirm that:
- the report is true to the best of your knowledge and concerns a person you employed or engaged;
- you have reported any crime to the Rwanda Investigation Bureau and will provide the case number where available;
- the evidence you upload is genuine and you are entitled to share it; and
- you will not use HomeTrust Protect to retaliate, settle a personal dispute or avoid paying wages owed.
We decide whether to verify, reject or amend a report, and the subject has a right of reply. Knowingly false or malicious reports are a serious breach of these Terms: we may close your account and you may be liable to the person concerned. You agree to indemnify HomeTrust against claims arising from reports you submit in breach of this section.
8.Wallet, pricing and payments
- Services are prepaid. You top up your wallet in Rwandan francs using MTN Mobile Money, Airtel Money, Visa / Mastercard. The minimum top-up is RWF 1,000.
- Prices are shown before you confirm and are charged when you send an invite or run an instant check. Prices include VAT where applicable.
- If you cancel an invite before the applicant has started, the full price is credited back to your wallet.
- Once an applicant has started, the price is not refundable, including where the applicant abandons the journey or a guarantor does not respond, except as set out in our Online SLA.
- Unused wallet balances may be refunded to the original payment method on request within 90 days of top-up, less any payment provider fees. Promotional and welcome credit has no cash value.
- We may change prices with at least 14 days' notice. Changes do not affect invites already sent.
9.API use
- API keys are created in Settings → API keys and must be kept secret and used only from your servers.
- You must not exceed reasonable rate limits, attempt to access data of other accounts, scrape or resell the services, or use the API to build a competing database.
- If you embed HomeTrust in your own product, you must display the HomeTrust consent screen unchanged and must not alter or misrepresent results.
- We may suspend keys that threaten the security or stability of the services.
10.Accuracy and limitations of reports
Reports are based on information from applicants, guarantors, referees, identity registries, partner clinics and field agents. We take care to verify this information, but we cannot guarantee that every source is accurate or complete, or predict a person's future behaviour.
A report and trust score are tools to support your decision; they are not a recommendation to hire or a guarantee of honesty or competence. You remain responsible for your hiring decision and for supervising the people you employ.
11.Prohibited conduct
- Using the services in breach of any law, including data protection, labour and anti-discrimination laws.
- Verifying someone without a genuine employment purpose or without their knowledge.
- Uploading malware, probing or bypassing security, or interfering with the services.
- Copying, reverse-engineering or reselling the services or reports.
- Harassing applicants, guarantors, referees, agents or HomeTrust staff.
12.Intellectual property
HomeTrust owns the website, apps, API, software, trust-score methodology, brand and content. We grant you a limited, non-exclusive, non-transferable licence to use the services and reports for your own hiring purposes while your account is active. You keep ownership of the content you submit and grant us the rights needed to provide the services.
13.Suspension and termination
You may close your account at any time. We may suspend or close an account that breaches these Terms, is used fraudulently, or where required by law. Where reasonable we will tell you why and give you an opportunity to respond.
On closure, any remaining paid wallet balance will be refunded except where the account was closed for fraud. Data is retained as described in the Privacy Policy.
14.Disclaimers and limitation of liability
The services are provided "as is" and "as available". To the extent permitted by law, HomeTrust is not liable for indirect or consequential losses, loss of profit, or loss or damage caused by the acts of a person you hire.
Our total liability to you for any claim relating to the services is limited to the amount you paid to HomeTrust in the three (3) months before the event giving rise to the claim. Nothing in these Terms limits liability for fraud, gross negligence or anything that cannot be limited under Rwandan law.
15.Governing law and disputes
These Terms are governed by the laws of the Republic of Rwanda. We will first try to resolve any dispute amicably within 30 days of written notice. Failing that, disputes may be referred to mediation or arbitration at the Kigali International Arbitration Centre (KIAC) by agreement, or otherwise to the competent courts of Rwanda in Kigali.
16.Changes to these terms
We may update these Terms. Material changes will be notified by email or in the app at least 14 days before they take effect. Continuing to use the services after that date means you accept the updated Terms.
